1. Data controller
Under Law No. 6698 on the Protection of Personal Data (KVKK), your personal data is processed by Hamurkâr Gıda Ticaret Ltd. Şti. (address: Cemal Gürsel Cad. No: 96/A, Karşıyaka / İzmir) as the data controller, within the scope described below.
2. Personal data processed
For online orders and the cake form: full name, phone, email, delivery address, delivery date, reference images and order notes; invoice and payment records (card details are processed only by the payment institution); CVs for job applications; email for the newsletter; IP address and cookie data when using the website; and security camera footage in the shops.
3. Purposes of processing
To receive, design, prepare, deliver and invoice orders; to meet allergen and diet requests safely; to answer complaints and suggestions; and, with your explicit consent, to announce campaigns and new products.
4. Legal grounds
Your data is processed under KVKK Art. 5/2 where it is directly related to concluding or performing a contract, necessary to meet a legal obligation, or based on legitimate interest; and on your explicit consent for marketing communications and cookies.
If the text or images to be printed on a cake contain third parties' personal data (for example photographs), you must declare that the relevant person has given permission for their use.
5. Transfers
Your data may be shared only to the extent necessary to provide the service with payment institutions, email/SMS infrastructure providers, accounting and legal advisers and competent public authorities. No data is transferred abroad unless the conditions of KVKK Art. 9 are met.
6. Retention
Order and invoice records are kept for 10 years, reference images for 6 months after delivery, job applications for 1 year and shop camera footage for 30 days. Marketing consent remains valid until withdrawn.
7. Your rights
Under KVKK Art. 11 you may learn whether your data is processed, request information, ask for correction or deletion, learn the third parties it is transferred to, object, and claim compensation for damage. Send your requests to kvkk@hamurkar.com.tr; they are answered within 30 days at the latest.
